MGK Pools Inc – Shipping, Refunds & Terms of Service

SHIPPING INFORMATION

Shipping Times

Most manufacturers are experiencing supply chain fluctuations. We work exclusively with reputable suppliers and relay their estimated timelines to you. While we strive for accuracy, these are estimates based on manufacturer communications.

Current Estimated Shipping Times (as of November 13, 2024):

New pool orders: 1-3 weeks
Pool bonding kits: 1-3 business days (in stock)
Pool pumps: Within 24 hours

Shipping Costs

Continental US: $200-$750 (location dependent)
Western states: Higher rates apply
Northwest and Western regions: Custom rates
Local pickup: $200 (by appointment)

Note: We do not maintain inventory. All orders incur shipping costs whether delivered to us or directly to you.

Shipping Process

All packages ship via trusted freight carriers
Service includes driver-assisted power tailgate (pallet lowered to ground level) delivery
Drivers deliver to your address only – placement beyond delivery point is customer’s responsibility
Commercial addresses: Please note if you have dock height or forklift availability at checkout or email info@mgkpools.com

Special Delivery Situations

In rare cases involving weight-restricted roads or bridges, you may need to:

Retrieve your order from the nearest shipping terminal
Arrange alternative delivery location with carrier

Tracking and Delivery

You will receive a PRO tracking number via email once shipped
Carrier will contact you to schedule delivery
IMPORTANT: Answer calls from unknown numbers – it may be your carrier
Customer is responsible for timely receipt to avoid terminal storage fees
Any storage fees will be charged to your original payment method

CRITICAL SHIPPING NOTICE

We typically subsidize shipping costs, even for “free shipping” offers. If you refuse delivery or request a return after shipping, you will be charged:

Full actual freight cost to your location
Full return freight cost to our facility
These charges often exceed the shipping amount you paid

RETURNS & REFUNDS

Cancellation Policy

Before Shipping: Full immediate refund, no questions asked
After Shipping: Subject to shipping cost recovery (see above)

Return Policy

Items may be returned within 14 days of receipt under these conditions:

Contact orders@mgkpools.com with order date and item number
Obtain RGA (Return Goods Authorization) number
Customer pays all shipping fees
Items must be unused, in good original packaging, resalable condition
Include all warranty cards, manuals, accessories

Non-Returnable Items

Chemicals
Lights
Battery-powered vacuums
Automatic cleaners
Heaters and heat pumps
Pool liners
Winter/leaf/solar covers (if wet, opened, or unfolded)

Refund Processing

Credits issued upon receipt and inspection of returned items, minus all shipping costs incurred.

PERMITS & COMPLIANCE

Building Permits

Customer Responsibility: All pools require local building permits
Customer must obtain permits BEFORE ordering
We cannot assist with permit applications
Orders placed without proper permits may result in shipping charges with no product
Special attention: Aquasport 52 inground installations may require updated documentation, or independent surveys or engineering fees

Sales Tax

Massachusetts Residents: Sales tax collected at checkout
All Other States: Customers are responsible for remitting applicable sales tax to their state/local authorities
Failure to pay required taxes is solely customer’s responsibility
MGK Pools Inc is not liable for any unpaid taxes, penalties, or interest you withheld

SHIPPING DAMAGE & CLAIMS

Inspection Requirements

Inspect all packages immediately upon delivery
Note any damage on delivery receipt BEFORE signing
Accept non-damaged items; replacements will be sent for damaged pieces
Special attention: Long toprail boxes for oval Aquasport 52 pools

Missing Items

Verify all items against packing slip before signing
Oval pools ship with rails beside (not on) pallet
Items signed as received become customer responsibility

Minor Damage

Professional installers routinely straighten minor bends in toprails that fit under trim caps. This does not affect warranty coverage.

TERMS & CONDITIONS

Jurisdiction & Delivery

Service available only within the United States
No shipments to US territories or international addresses
Risk of loss transfers upon carrier pickup

Pricing

Prices subject to change without notice
MGK Pools Inc reserves the right to cancel orders with pricing errors
Customers may pay difference or return merchandise if price increases after order

Warranties

All manufacturer warranties apply as stated
Warranty claims must be filed according to manufacturer procedures
Installation must comply with manufacturer specifications to maintain warranty

Limitation of Liability

MGK Pools Inc’s liability shall not exceed the purchase price of the product. We are not responsible for:

Indirect, incidental, or consequential damages
Lost profits or opportunities
Installation errors or costs
Permit or code compliance issues

Dispute Resolution

Any disputes shall be resolved through binding arbitration in Massachusetts according to American Arbitration Association rules. Customer waives right to jury trial or class action participation.

Force Majeure

MGK Pools Inc is not liable for delays or failures due to circumstances beyond our control, including but not limited to:

Natural disasters
Pandemic or epidemic
Government actions
Labor disputes
Supplier failures
Transportation disruptions

Governing Law

These terms are governed by Massachusetts law, without regard to conflict of law principles.
