Shipping, delivery, returns, and refund policies are covered in our Shipping & Returns Policy. How we handle your information is covered in our Privacy Policy. Both are part of these terms.
Jurisdiction & Delivery
- Service available only within the United States
- No shipments to US territories or international addresses
- Risk of loss transfers upon carrier pickup
Pricing
- Prices are subject to change without notice
- MGK Pools Inc reserves the right to cancel orders affected by pricing errors; in the event of a cancellation, all associated fees will be credited or refunded within 30 days
- If a price increases after your order, you may pay the difference or return the merchandise; customers are not entitled to merchandise at an erroneous price
Building Permits
- All pools require local building permits — obtaining them is the customer’s responsibility, BEFORE ordering
- We cannot assist with permit applications
- Orders placed without proper permits may result in shipping charges with no product
- Aquasport 52 inground installations may require updated documentation, independent surveys, or engineering fees
Sales Tax
- Massachusetts residents: sales tax collected at checkout
- All other states: customers are responsible for remitting applicable sales/use tax to their state and local authorities
- MGK Pools Inc is not liable for any unpaid taxes, penalties, or interest
Warranties
- All manufacturer warranties apply as stated
- Warranty claims must be filed according to manufacturer procedures
- Installation must comply with manufacturer specifications to maintain warranty
Limitation of Liability
MGK Pools Inc’s liability shall not exceed the purchase price of the product. We are not responsible for:
- Indirect, incidental, or consequential damages
- Lost profits or opportunities
- Installation errors or costs
- Permit or code compliance issues
Dispute Resolution
Any disputes shall be resolved through binding arbitration in Massachusetts according to American Arbitration Association rules. Customer waives the right to jury trial or class action participation.
Force Majeure
MGK Pools Inc is not liable for delays or failures due to circumstances beyond our control, including but not limited to natural disasters, pandemic or epidemic, government actions, labor disputes, supplier failures, and transportation disruptions.
Governing Law
These terms are governed by Massachusetts law, without regard to conflict of law principles.
SMS/Text Messaging Terms
MGK Pools Inc sends text messages only to customers who have opted in to receive them. Opting in is always optional and is never a condition of purchase or service. Message types include responses to your inquiry (such as links you requested), callback and appointment confirmations, and appointment reminders.
